Rbg - General instructions for use
General information on rbg
- Rustbird greenline sro, registered in the Commercial Register of the Court in Prague under ID ID: 03549488, with its registered office at Primátorská 296/38, 180 00 Prague 8, is currently building the rbg platform " www.chalet-beskydy.cz " (hereinafter "rbg S.r.o." or "Platform").
- rbg S.r.o. will be an Internet service platform for national and international accommodation of guests, as well as medical and non-medical patient flow channeling. rbg S.r.o. will also arrange appointments with third-party providers via Internet platforms.
- On the platform, interested guests. Consumers and patients can view information about accommodation options at Chalet Beskydy as well as medical and non-medical services from rbg and third-party providers and can register for these. RBG accepts no liability whatsoever. The user is fully liable for all damages caused by him or by his third parties.
- There is currently no brokerage of services of rbg S.r.o. and its third-party providers via the platform. It merely serves to inform potential consumers and patients about the services offered here in the future and to pre-register the rbg card without any legal obligation or commitment.
- In the case of the purchase of other goods such as medical items, the statutory provisions shall apply. The goods remain the property of rbg until payment has been made in full.
- For the purchase of recycler goods furniture in the form of complete trucks, the goods remain the property of rbg until full payment has been made. These goods may also not be sold in order to pay for the ordered and received truck. If no. 6 is violated, non-payment of the goods shall be considered embezzlement in accordance with § 246 of the German Criminal Code or theft in accordance with § 243 of the German Criminal Code. If there is more than one item, each individual item is considered a case of embezzlement or theft. This will be reported in accordance with the STPO and prosecuted under criminal law and civil law in accordance with the ZPO. Germany is responsible for criminal and civil prosecution, as is the country where the damage occurred. Alternatively, prosecution must take place in both countries. EU law may regulate the special features. These GTCs apply to all invoices, orders and business transactions.
- Definition of retention of title:
If the seller of a movable item has reserved ownership until the purchase price has been paid, it can be assumed in case of doubt that ownership is transferred subject to the condition precedent of full payment of the purchase price (retention of title). Retention of title is an important instrument of German civil law, in particular property law. It makes the transfer of a movable item or necessary agreement in accordance with Section 158 BGB subject to a condition precedent. Only when this effect occurs is there a legal transfer of ownership in accordance with §§ 929 ff. BGB. Upon purchase, the buyer initially receives a so-called expectant right, which is converted into "full ownership" when the agreed condition is met. In this case, payment of the invoice for the goods delivered subject to retention of title. Payment of the goods in cash is expressly agreed. This is also a reason to withdraw from the contract, which is deemed to have been agreed by both parties. The agreed payment shall be made on demand, unless otherwise agreed, or 14 days after delivery of the goods subject to retention of title.
In principle, retention of title shall apply in all cases of non-immediate payment on delivery or advance payment. - Reversal of the retention of title:
According to § 449 para. 2 BGB, it is possible to subsequently withdraw from the reservation. However, this requires that the seller has withdrawn from the contract. Therefore, in addition to a declaration of withdrawal in accordance with Section 349 BGB, there must first and foremost be a reason for withdrawal. This can be contractually agreed between the parties or arise from the law. After withdrawal, the seller receives a claim for restitution against the buyer under Section 985 BGB and Section 346 I BGB, which can also be enforced in court if necessary. In addition, the seller would have a claim for damages from §§ 280 ff. BGB.
Instructions for use
- This applies to all services offered. In particular for the possible services that are offered and can be purchased via the platform or to obtain information about specific offers of a medical or non-medical nature.
- It is possible to register for a newsletter, which provides regular information on the development progress of the platform and other topics. At the same time, you can register for the rbg card without any legal obligation or commitment.
- The General Terms and Conditions apply to all business transactions, whether online, by telephone order, by fax or other written or verbal transmissions.
- The provisions of rbg S.r.o.'s privacy policy apply to the use of the platform. The user of this website is expressly prohibited from downloading, republishing, retransmitting, reproducing or otherwise using the image/sound/video material on the website.
Accommodation, overnight stays
- Bookings via Booking.com, AIRBNB, VRBO, e-chalupy and all other booking platforms are governed by their terms and conditions.
- Direct bookings via all media such as website, WhatsApp, mail or fax are subject to these terms and conditions.
- All bookings here are to be paid 100% in advance 14 days against invoice. Up to 7 days in advance can be cancelled for good cause, such as illness against proof of 50% of the costs paid. Thereafter, cancellation is excluded and the amount paid remains with the landlord. A replacement guest can be provided by the booker.
- Medical and rehabilitation treatments:
- All booked treatments are payable up to 24 hours before the treatment date. Appointments can be postponed if this is possible at the booked facility. The full amount of the treatment fee must be paid if you do not turn up for the appointment.
- Exceptions and concessions are possible at any time.
- Prices: The prices quoted are an offer and are always for 2 people plus children up to the age of 5. The price increases for more than 2 persons. The price must be requested. The offers are always subject to change and subject to prior sale. This also applies to the advertisements of available and sold-out accommodation in the individual calendars.
